Terms of Service

These Terms of Service ("Terms") govern your access to and use of jetandswim.com (the "Site"), operated by Sunstate Bay Ventures, LLC, a Florida limited liability company doing business as Jet and Swim ("Jet & Swim," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. What Jet & Swim is

Jet & Swim is a curated editorial travel directory focused on adults-only, water-forward resorts. We research, review, and recommend properties based on independent editorial judgment.

When you click a booking link on the Site, you are taken to a third-party booking partner (such as Booking.com, Hotels.com, Stay22, Travelpayouts, or a resort's own website) where any booking, payment, and contractual relationship is solely between you and that third party, under their terms and policies.

Separately, Sunstate Bay Ventures, LLC acts as an independent travel advisor affiliated with Fora Travel. Where you choose to book a stay through our advisory service rather than a booking link, your reservation, payment, and contractual relationship are governed by Fora and the applicable supplier (the resort, hotel group, or their partners) under their terms and policies. Editorial inclusion in the directory and Jet's Picks is set independently of whether a property can be booked through our advisory service.

2. Editorial content

We work to keep information about resorts accurate and current, but the Site is provided for general informational purposes only. Resorts change ownership, renovate, modify amenities, close sections, and update pricing without notice. Room categories, swim-up access, adults-only designations, and other features described on the Site may differ from what is currently offered.

You are responsible for verifying all material details directly with the resort or booking partner before booking and before traveling. This includes, but is not limited to, room type, adults-only status, included amenities, dates of operation, COVID-era policies, accessibility, and total cost. Editorial descriptions, "Jet's Picks," and similar designations reflect our opinion at the time of publication and are not guarantees of any specific experience.

3. Affiliate & advisor relationships

Jet & Swim participates in affiliate programs. When you click certain booking links and complete a qualifying booking, we may earn a commission at no additional cost to you. Affiliate relationships do not influence which resorts appear in the directory or which receive a Jet's Pick — our editorial standards are set independently of commercial relationships.

As an independent travel advisor affiliated with Fora Travel, we may also earn a commission from a resort, hotel group, or supplier when you book a stay through our advisory service. This commission is paid by the supplier, not added to your rate. As with affiliate links, advisor commissions do not influence editorial inclusion, Jet's Picks, or the order in which properties are presented.

We disclose these relationships in keeping with the U.S. Federal Trade Commission's guidance on endorsements. For details on data collected by affiliate partners, see our Privacy Policy.

4. No travel advice

Nothing on the Site constitutes legal, medical, financial, immigration, or professional travel advice. Travel involves risk, including but not limited to risks related to health, safety, weather, transportation, foreign laws, currency, and political conditions. You are responsible for assessing those risks, obtaining appropriate insurance, and complying with applicable laws, including passport, visa, and entry requirements.

5. Intellectual property

The Site and its original content — including written reviews, "Jet's Picks" notes, editorial commentary, photographs taken by us, branding, logos, and the overall selection, arrangement, and presentation of resorts — are owned by Sunstate Bay Ventures, LLC and are protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may:

• View, browse, and personally use the Site for non-commercial purposes.
• Share links to individual pages on social media or in private messages.
• Quote brief excerpts (a sentence or two) with clear attribution and a link back to the source page.

You may not:

• Copy, scrape, republish, syndicate, or redistribute Site content in whole or in substantial part, in any medium, without our prior written permission.
• Use any automated system (including scrapers, bots, or AI training pipelines) to access, copy, or extract content from the Site.
• Use Jet & Swim names, marks, logos, or branding except as expressly permitted in writing.
• Frame, mirror, or otherwise present the Site as your own.

Third-party content on the Site — including resort photographs supplied by properties or booking partners, brand names, and logos — remains the property of its respective owners and is used under license, fair use, or with permission.

6. Acceptable use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the Site, its servers, or related systems.
• Interfere with or disrupt the Site, introduce malware, or otherwise impair the experience of other users.
• Submit false, misleading, or fraudulent information through any contact form, email signup, or other input.
• Use the Site to harvest personal information about other users or to send unsolicited communications.

7. Third-party sites and services

The Site links to third-party websites and services, including booking partners, affiliate networks, social media platforms, and other resources. We do not control those third parties and are not responsible for their content, policies, products, services, availability, or practices. Your interactions with any third-party site or service are governed by that third party's own terms and policies, and any transaction you enter into with a third party is solely between you and that third party.

8. Disclaimers

The Site and all content on it are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, availability, and uninterrupted operation.

We do not warrant that resort descriptions, prices, availability, amenities, photos, or other information on the Site are accurate, current, or complete. We do not warrant that the Site will be free of errors, viruses, or interruptions. We do not endorse, guarantee, or assume responsibility for any product or service offered by any third party referenced on the Site.

9. Limitation of liability

To the fullest extent permitted by applicable law, in no event shall Sunstate Bay Ventures, LLC, its members, officers, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the Site, your inability to use the Site, or any content on the Site — whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not we have been advised of the possibility of such damages.

In no event shall our total cumulative liability to you for all claims arising out of or related to the Site exceed one hundred U.S. dollars (US$100.00).

We are not responsible for any aspect of your travel experience, including but not limited to issues with reservations, payments, refunds, accommodations, flights, transfers, illness, injury, lost or damaged property, weather, natural disasters, or the acts or omissions of any resort, booking partner, airline, or other third party.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In those jurisdictions, our liability is limited to the fullest extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless Sunstate Bay Ventures, LLC and its members, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any content you submit through the Site.

11. Changes to the Site and these Terms

We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be highlighted on the homepage or via our email list. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

12. Termination

We may, in our sole discretion, restrict or terminate your access to the Site at any time, with or without notice, for any reason, including any violation of these Terms. Sections 5 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), 13 (Governing Law and Disputes), and any other provisions that by their nature should survive will survive termination.

13. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Pinellas County, Florida, and you consent to the personal jurisdiction of those courts.

To the fullest extent permitted by applicable law, you and Jet & Swim each waive any right to a jury trial and any right to participate in a class action with respect to any such dispute.

14. Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Jet & Swim regarding the Site and supersede any prior agreements.
